Terms of Service

A Thermes USA LLC dba I’m Your Trip looks forward to the opportunity to act as your booking agent for your travel needs. The following terms of service (the “Terms of Service”) describe what you are legally entitled to expect from us when you purchase travel related services (referred to as “Tour”) through our Site (as described below), in addition to your obligations as a customer. The terms “we”, “us” and “our” refer to I’m Your Trip. The term “you” refers to the customer visiting our Site, filling our contact form and booking a Tour through our Site or otherwise using our services. Our Site, which is referred throughout this Terms of Service, can be found at this link.

  1.  Accepting these Terms of Service

In order for you to purchase a Tour, you must first accept these Terms of Service. You can accept these Terms of Service by clicking on our box, which will be prompted during your purchase of the Tour, which reads: “I have read and agree to the Terms of Service.”

You may wish to print or save a local copy of the Terms of Service for your records, but note that these Terms of Service may be altered from time to time, so be sure to check our Site periodically.

  1. Booking with I’m Your Trip.
  1. Confirmation.
  • (a) Your trip is confirmed and a contract exists when we issue a written confirmation after receipt of the applicable deposit amount (“Confirmation”).
  • (b) At the time of booking, a non-refundable deposit of US 30% of total price, per person, per Tour, is due to I’m Your Trip “(Deposit”). If the booking is made 60 days or less prior to departure, full payment is due at the time of booking.
  • (c) The Confirmation sent by I’m Your Trip will contain details of final payment required for any booking. Payment of the balance of the price for any products or services booked is due [60] days before the departure date of the first product or service included in the applicable booking. If full payment is not received by the applicable due date, I’m Your Trip may, at its sole discretion, change the rate payable for the booking, or treat the booking as cancelled and retain the Deposit paid on booking as a cancellation fee.
  • (d) You must be at least [21] years of age to make a booking and/or to participate in any Tour.
  • (e) Please check your Confirmation carefully and report any incorrect or incomplete information to us immediately. Please ensure that all names provided are exactly as stated in the relevant passport. You agree to provide full, complete and accurate information to I’m Your Trip.
  1. Booking on Behalf of Others
  • (a) By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that Tour. This means that you are responsible for making all payments due in connection with your Tour, notifying I’m Your Trip if any changes or cancellations are required and keeping your parties informed.
  • (b) By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents from such person or persons. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate. I’m Your Trip will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
  1. Medical Information.
  • (a) You must provide any medical information reasonably requested by I’m Your Trip and to complete the medical information form (“Medical Form”) when you are booking a trip from our Site.
  • (b) You agree to complete the Medical Form honestly and to disclose all relevant medical information accurately and fully. I’m Your Trip will maintain the information in accordance with I’m Your Trip’s Privacy Policy available at the Site.
  • (c) I’m Your Trip reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a Tour.
  • (d) I’m Your Trip reserves the right to deny you permission to travel or participate in any aspect of a Tour at any time and at your own risk and expense where I’m Your Trip determines that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others. In the event I’m Your Trip denies you permission to travel due to your physical or mental condition, your Deposit will be refunded.
  • (e) Pregnancy is considered a medical condition and must be disclosed to I’m Your Trip at the time of Booking. [I’m Your Trip may refuse to carry pregnant women over 24 weeks.] I’m Your Trip may refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.
  • (f) You are responsible for assessing whether a Tour is suitable for you. You should consult your physician to confirm your fitness for travel and participation in any planned activities. You should seek your physician’s advice on vaccinations and medical precautions. I’m Your Trip does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the Tour based on your own unique circumstances, limitations, fitness level and medical requirements.
  • (g) Travel with I’m Your Trip may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries you may visit on your Tour varies and I’m Your Trip makes no representations and gives no warranties in relation to the availability or standard of medical facilities in those regions.
  1. Insurance.

You acknowledge that insurance coverage is not included in the cost of any Tour offered by I’m Your Trip and you are required to obtain separate coverage at an additional cost. It is your responsibility to ensure that you have sufficient coverage and comply with the terms of the applicable insurance plans. You are responsible for advising your insurer of the type of travel, destination(s) and activities included in your booking so that the insurer may provide appropriate coverage. You are strongly recommended to extend your coverage to include cancellation, curtailment, and all other expenses that may arise as a result of loss, damage, injury, delay or inconvenience while traveling.

  1. Products and Suppliers.

I’m Your Trip makes arrangements with accommodation providers, activity providers, airlines, cruise lines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties (“Suppliers”) to provide you with some or all of the components of your booking. Each Supplier has its own terms and conditions that are applicable to your particular arrangements in addition to our Terms of Service, and you should make sure you understand them.

I’m Your Trip is acting as intermediary or “booking agent” for products and services that are not directly supplied by us (e.g., ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.

Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You may be charged additional sums by I’m Your Trip to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. By accepting this Terms of Service, you hereby consent to any post-purchase price increases and authorize I’m Your Trip to charge your credit card for such additional amounts.

  1. Deposits and Payment.

Any Deposit from you is non-refundable. Payment of a Deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. You agree to indemnify IYT for any chargebacks and/or holdbacks from your bank or financial institution. Full payment is required 60 days prior to departure for a Tour. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers.

  1. Cancellations and Changes by I’m Your Trip and/or Suppliers.

We will ensure that you are promptly notified of any significant change affecting your Tour once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply.

You are responsible for making airline travel arrangements. We have no control over airline schedule changes and accept no liability for costs which may arise as a result of such changes. It is your responsibility to check with the airline that any flights you have confirmed are operating as booked. We strongly recommend that you contact your airline at least 72 hours before the scheduled departure of each flight to do this. Please note that for some airlines it is mandatory to confirm with them your intention to fly.

  1. Cancellations by Customer.

You may cancel your booking by notifying I’m Your Trip. Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received by I’m Your Trip and are expressed as a percentage of the total price paid for the cancelled Tour:

  • (a) Cancellation received 60 days or more before departure: Deposit will be held by I’m Your Trip, the remainder of the payments made to I’m Your Trip in respect of the cancelled Tour will be refunded.
  • (b) Cancellation received 59-30 days before departure: Deposit will be held by I’m Your Trip, an amount equal to 50% of the remainder of the payments made to I’m Your Trip in respect of the cancelled Tour will be refunded.
  • (c) Cancellation less than 30 days before departure: Deposit will be held by I’m Your Trip, and no further refund will be payable.
  1. Travel Documents and Destinations.

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits and certificates (including but not limited to vaccination or medical certificates) and insurance policies. You must have a passport that is valid 6 months after the last date of travel with I’m Your Trip as set out on your itinerary. You accept full responsibility for obtaining all such documents, visas and permits prior to the start of the Tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by I’m Your Trip that is a direct result of your failure to secure or be in possession of proper travel documentation. I’m Your Trip does not provide advice on travel documents and makes no representations or warrantees as to the accuracy or completeness of any information provided on visas, vaccinations, climate, clothing, baggage, or special equipment and you agree that I’m Your Trip is not responsible for any errors or omissions in this information.

Your travel documents are valuable and should be safeguarded as if they were cash. It is not always possible to replace travel documents in the case of loss, theft, damage, etc.

Prior to booking international travel, we recommend that you review any. government’s prohibitions, warnings and advisories issued by your country of residence and/or citizenship which applicable to your destinations. By offering travel to any particular destination, we do not represent that travel in such destination is safe or without risk.

  1. Travel Advice.

U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at travel.state.gov for all the countries you intend to visit.

  1. Flexibility and Unused Services.

You acknowledge that the nature of adventure travel requires flexibility and acknowledges that you will permit reasonable alterations to products, services or itineraries by I’m Your Trip. The schedules, accommodations, activities, amenities and mode of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of I’m Your Trip (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties). No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to no fault of I’m Your Trip, including your removal from a Tour because of your negligence or breach of this Terms of Service.

  1. Acceptance of Risk.

You acknowledge that adventures travel and the products and services offered by I’m Your Trip may involve a significant amount of risk to your health and safety. By traveling with I’m Your Trip you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risk and release I’m Your Trip from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in the Tour offered by I’m Your Trip.

You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in “extreme sports” or other high-risk activities, or travel to countries with developing infrastructure. Standards of hygiene, accommodation and transport in certain countries where Tours take place are often lower than the standards you may reasonably expect in your home country or region. You agree that I’m Your Trip is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where a Tour, product or service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.

You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on Tour or, if in the opinion of I’m Your Trip (acting reasonably), your behavior is causing or is likely to cause danger, distress or material annoyance to others, I’m Your Trip may terminate your travel arrangements on any product or service immediately at your expense and without any liability on I’m Your Trip’s part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.

You are responsible for any costs (including repair, replacement and cleaning fees) incurred by I’m Your Trip or I’m Your Trip’s Suppliers for property damage, destruction or theft caused by you while on a Tour. You agree to immediately report any pre-existing damage to a representative of I’m Your Trip and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.

You agree to take all prudent measures in relation to your own safety while on Tour including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither I’m Your Trip nor its Suppliers are liable for loss or damages caused by your failure to comply with safety instructions or warnings.

You agree to bring any complaints to I’m Your Trip as soon as possible in order to provide I’m Your Trip with the opportunity to properly address such complaint. You agree to inform your Tour leader, another representative of I’m Your Trip or I’m Your Trip’s customer service department directly. I’m Your Trip assumes no liability for complaints that are not properly brought to the attention of I’m Your Trip and cannot resolve or attempt to resolve complaints until proper notice is provided. Any complaint made after the completion of a Tour must be received in writing by I’m Your Trip within 30 days of the last day of travel of the booking in question.

  1. I’m Your Trip is not Liable for Suppliers.

Although I’m Your Trip takes reasonable care in selecting Suppliers, I’m Your Trip is unable to control Suppliers, does not supervise Suppliers and therefore cannot be responsible for their acts or omissions. Any services provided by Suppliers are subject to the terms and conditions imposed by these Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and Terms of Services that govern the provision of their services. These may limit or exclude liability of the Suppliers. You acknowledge that Suppliers operate in compliance with the applicable laws of the countries in which they operate and I’m Your Trip does not warrant that any Suppliers are in compliance with the laws of your country of residence or any other jurisdiction.

I’M YOUR TRIP IS NOT LIABLE AND WILL NOT ASSUME RESPONSIBILITY FOR ANY CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES ARISING OUT OF INCONVENIENCE, LOSS OF ENJOYMENT, UPSET, DISAPPOINTMENT, DISTRESS OR FRUSTRATION, WHETHER PHYSICAL OR MENTAL, RESULTING FROM THE ACT OR OMISSION OF ANY PARTY OTHER THAN I’M YOUR TRIP AND ITS EMPLOYEES.

I’m Your Trip is not liable for the acts or omissions, whether negligent or otherwise, of Suppliers or any independent contractors.

  1. Optional Extras.

Optional Extras” refers to any activity, transportation, meal, product or service not expressly included in the Tour itinerary or price of the Tour and do not form part of the Tour. You agree that any assistance given by I’m Your Trip’s representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and I’m Your Trip makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or any information provided by any representative of I’m Your Trip regarding any Optional Extras. You release I’m Your Trip from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras.

You acknowledge and agree that any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury or loss of or damage to property associated with Optional Extras is the sole responsibility of the third party providing that service or activity.

  1. Liability.

I’m Your Trip and its parents, subsidiaries and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for (A) any damage to, or loss of, property or bodily injury (including emotional distress or injury)to, illness or death of, persons occasioned directly or indirectly by an act or omission of any Supplier or other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such Supplier or other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against I’m Your Trip for any such loss, damage, injury, or death.

In the event that any loss, death, injury or illness is caused by the negligent acts or omissions of I’m Your Trip, then I’m Your Trip limits its liability, where applicable by all applicable international conventions.

Notwithstanding anything to the contrary elsewhere in this Terms of Service, I’m Your Trip will not in any circumstances be liable to you for any loss or anticipated loss of profit, loss of enjoyment, loss of revenue, loss of use, loss of contract or other opportunity nor for any other consequential or indirect loss or damage of a similar nature.

For claims not involving personal injury, death or illness, any liability I’m Your Trip may incur for the negligent acts or omissions of its Suppliers will be limited to a maximum of the price which you paid for the applicable Tour, not including insurance premiums and administration charges. Where this relates to loss or damage to luggage and other personal possessions then I’m Your Trip liability will not exceed US$1,000. I’m Your Trip will not at any time be liable for any loss of or damage to valuables of any nature. You agree that you will be precluded from making a double recovery by making the same claims and seeking recovery against I’m Your Trip and its Suppliers, contractors or other third parties.

  1. Force Majeure.

I’m Your Trip will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for I’m Your Trip failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of I’m Your Trip; or an event which I’m Your Trip or the Suppliers, even with all due care, could not foresee any and all of which, individually and collectively, constitute “Force Majeure.”

  1. Images and Marketing.

You agree that, while participating in any Tour, images, photos or videos may be taken by other participants, I’m Your Trip or its representatives that may contain or feature you. You consent to any such pictures being taken and grants a perpetual, royalty-free, worldwide, irrevocable license to I’m Your Trip, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.

  1. Privacy Policy.

I’m Your Trip must collect your personal information to deliver the Tour and any products or services booked. I’m Your Trip collects, uses and discloses only that information reasonably required to enable I’m Your Trip and its Suppliers to provide the particular Tour, products and/or services that you have requested as described in I’m Your Trip’s Privacy Policy, which can be accessed any time at I’m Your Trip’s Site and is expressly incorporated into this Terms of Service. By submitting any personal information to I’m Your Trip, you indicate your acceptance of I’m Your Trip’s Privacy Policy.

  1. Severability.

If any provision of this Terms of Service will be held to be invalid or unenforceable for any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of this Terms of Service is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision will be deemed to be written, construed, and enforced as so limited.

  1. Applicable Law

This Terms of Service shall be construed in accordance with the laws of the State of Florida, United States.

  1. Jurisdiction

Any legal action or proceeding with respect to this Terms of Service may be brought in the state or federal courts of the State of Florida, United States. The parties hereby accept the non-exclusive jurisdiction of the aforesaid courts. Further, the parties hereby irrevocably waive any objection which they may now or hereafter have to the laying of venue of any of the aforesaid actions or proceedings arising out of or in connection with this Terms of Service brought in the courts referred to above and hereby further irrevocably waive and agree not to plead or claim in any such court that any such action or proceeding brought in any such court has been brought in an inconvenient forum.

  1. Modifications to These Terms of Service.

I’m Your Trip reserves the right to modify these Terms of Service, without prior notice, at any time and from time to time. Any such modification is effective upon the posting of same by I’m Your Trip on its Site. I’m Your Trip may also notify you of any modifications by email or other correspondence to the your designated contact address. I’m Your Trip recommends that you review these Terms of Service periodically for any changes that may have been made. Your continued use of I’m Your Trip’s services or Site subsequent to any such changes means that you agree to be bound by those changes. The most current version of these Terms of Service and such polices supersedes all previous versions.
